In a recent development, a new law called Act 247 has been signed into law, aiming to address the legal challenges surrounding waterfront development in Wisconsin. The legislation, driven by a local government in collaboration with businesses, aims to revitalize shorelines while ensuring public access and interest in future use.
The public trust doctrine, which plays a crucial role in environmental protection in Wisconsin, was highlighted as a key principle in the preservation of lakes and rivers for public use and the state's tourism industry. However, concerns were raised about activists misusing this doctrine to block environmentally-sound developments on previously filled lakebeds.
The law, supported by various organizations including the League of Wisconsin Municipalities and Wisconsin Realtors Association, is seen as a significant step towards resolving the legal uncertainties surrounding historically-filled lands. It is emphasized that this legislation allows for the utilization of idle waterfront parcels without compromising public enjoyment of navigable waters.
Expressing satisfaction with the new law, an unnamed Committee Chair involved in its development thanked the authors, Senator Stroebel and Representative Wittke, as well as the supporters and the Department of Natural Resources for their contributions to crafting a bill that addresses the legal challenges surrounding waterfront development.
