The Wisconsin Supreme Court has determined that the Joint Committee on Review of Administrative Rules (JCRAR), which is controlled by Republicans, acted unconstitutionally by interfering with agency rule-making.
Following the decision, State Senator Kelda Roys (D-Madison), who serves on the JCRAR, issued a statement addressing the court's ruling. She said:
“Wisconsinites rightly expect our state government to provide quality services, enforce the law fairly, and set reasonable regulatory standards.
“Unfortunately, under Republican rule, JCRAR and other committees have abused their power, unconstitutionally working to prevent the executive branch from carrying out our laws. The legislature has the power to pass laws – not veto them after enactment.
“Republican politicians have used unconstitutional power grabs to prevent our government from tackling some of the most pressing problems – from PFAS contamination to abusive practices that harm LGBTQ youth to ensuring fair and secure elections to enacting modern building and safety codes. Fortunately, the Supreme Court is standing up for all of us and our democracy.
“Today’s court decision is a victory for Wisconsinites, who deserve the freedom to have a government responsive to everyday people, not special interests and right-wing extremists. This decision sends a clear message: We are working toward making Wisconsin a place where everyone can build a better life.”
The ruling comes as part of ongoing debates in Wisconsin over legislative oversight versus executive authority in state governance. The JCRAR had previously exercised significant influence over administrative rules proposed by state agencies.
