On July 20, 2021, as President Joe Biden's Presidential Commission on the Supreme Court of the United States convened to consider potential changes to the court's composition, a movement began in Wisconsin aimed at preserving its current structure. Wisconsin state Senators Julian Bradley and Eric Wimberger, along with Representative Tony Kurtz, initiated a resolution intended to prevent the expansion of the court beyond its existing nine justices.
The initiative, known as the "Wisconsin Keep 9 Resolution," seeks to establish a constitutional convention to discuss an amendment that would require nine states' approval. Unlike other states that have opted for simple resolutions regarding this matter, Wisconsin lawmakers are pursuing a more direct approach.
In a memo circulated among potential co-sponsors and shared with Secrets, Bradley, Wimberger, and Kurtz emphasized their strategy: “Legislators in other states have urged their members of Congress to amend the constitution. However, as a legislature we do have the power to call for a constitutional convention directly, and that is what this joint resolution does.”
Senator Bradley expressed his concerns in a statement to Secrets: “Wisconsin cannot stay silent while President Biden, Speaker Pelosi and Leader Schumer discuss packing the Supreme Court because they don't like the justices. We must exercise our power and call for a constitutional convention to say the Supreme Court will have nine justices -- period.”
